1. Agreement to Terms

By accessing or using the Berri app ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree with any part, please do not use the Service.

You represent that you are at least 13 years old. If you are under 13, you may not use the Service.

Your access to and use of Berri is also subject to our Privacy Policy.

2. Definitions

"App" refers to Berri, operated by LudoRlr LLC.
"We", "Us", "Our" refers to LudoRlr LLC.
"You" refers to the individual using the Service.
"Device" means any device that can access the Service such as a smartphone or tablet.

3. Our Services

Berri is an AI-powered nutrition app that helps users track meals, weight, and receive personalized feedback. The information provided is for general wellness purposes and is not medical advice. Always consult a healthcare provider before making significant changes to your diet or lifestyle.

4. Account Registration

To access certain features, you must create an account with your:

• Email address and password
• Basic information such as name, dietary goals, and activity level

You are responsible for safeguarding your login credentials and all activity on your account.

5. Subscriptions & Payments

App access requires a paid subscription:

• Subscriptions are managed by Apple and auto-renew unless canceled
• You may cancel anytime through your App Store account
• No refunds are issued for unused time unless legally required

6. Use Restrictions

You agree not to:

• Use the Service for unlawful purposes
• Copy, distribute, or reverse-engineer any part of the App or AI features
• Interfere with or disrupt the Service

We may suspend or terminate your account if you violate these Terms.

7. Intellectual Property

All content, trademarks, and software used in the Service are owned by LudoRlr LLC or its licensors. You may not use our branding or content without permission.

8. Disclaimers

The Service is provided "as is" and "as available" with no warranties. We do not guarantee:

• Achievement of your health goals
• Uninterrupted or error-free access

9. Limitation of Liability

To the fullest extent allowed by law, LudoRlr LLC will not be liable for indirect, incidental, or consequential damages, including but not limited to:

• Loss of data or access
• Personal health issues
• System failures or downtime

If we are found liable for any reason, our liability is limited to the greater of $100 or the amount you paid in the last 12 months.

10. Termination

We may terminate or suspend your access at any time, with or without notice, if you violate these Terms. Upon termination, your right to use the Service will cease immediately.

11. Governing Law

These Terms are governed by the laws of California, USA, without regard to conflict of law principles. Any legal actions must be filed in Sacramento County, California.

12. Changes to These Terms

We may update these Terms occasionally. If we make material changes, we’ll notify you via email or in-app. By continuing to use the Service after changes are effective, you agree to the updated Terms.
